Terms of Service

1. Agreement

By using CounterHype, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Fitness and nutrition disclaimer

CounterHype provides general fitness, nutrition, and habit-support information. It is not medical advice, diagnosis, treatment, physical therapy, or a substitute for a qualified professional. Talk to a medical professional before starting or changing exercise or nutrition practices, especially if you have a medical condition, injury, are pregnant, take medication, or are unsure what is safe for you.

Stop exercising and seek help if you experience chest pain, fainting, severe shortness of breath, sharp pain, dizziness, or symptoms that feel unsafe. Use judgment. A missed day is better than an injury.

3. Eligibility and accounts

You are responsible for the information you enter, the security of your account, and activity that happens through your account. Do not share credentials or use CounterHype on behalf of someone else without proper permission.

4. Subscriptions, trials, and billing

CounterHype Pro may be offered as a paid subscription. Prices, billing periods, trials, introductory offers, renewal terms, and included features are shown before purchase in the app store, checkout flow, or paywall.

• Subscriptions renew automatically unless canceled before renewal.
• Trials may convert to paid subscriptions unless canceled before the trial ends.
• Manage or cancel app-store subscriptions through the Apple App Store or Google Play account used for purchase.
• Deleting the app or deleting your account does not automatically cancel an app-store subscription.
• Refunds are handled by the store or payment platform that processed the purchase, unless applicable law requires otherwise.

5. Restore, export, and account deletion

Where available, CounterHype lets you restore purchases, sync cloud data, restore cloud backups, and export JSON data. You can request account deletion through Delete Account. Some data may be retained where needed for security, accounting, legal, or fraud-prevention reasons.

6. Food, label, and AI estimates

Nutrition information, barcode results, label scans, and AI-assisted meal estimates may be incomplete or inaccurate. They are provided to make logging easier, not to diagnose, treat, or manage a medical condition. You are responsible for checking important nutrition information, including allergens and medical dietary restrictions.

7. User content and submissions

You may enter foods, notes, logs, images, labels, or other content. You keep ownership of your content, but grant CounterHype permission to host, process, display, back up, analyze, and use it to provide the service. If you submit food data to a shared or community catalog, you give CounterHype permission to review, moderate, edit, reject, or publish that submitted data for other users.

8. Acceptable use

• Do not misuse the service, interfere with security, or attempt unauthorized access.
• Do not submit illegal, harmful, infringing, deceptive, or abusive content.
• Do not scrape, reverse engineer, or overload the service except where allowed by law.
• Do not use CounterHype to provide medical, dietetic, or professional coaching services to others unless you are responsible for your own compliance.

9. Third-party services

CounterHype may rely on third-party services for authentication, cloud storage, analytics, crash reporting, subscriptions, app-store purchases, connected health permissions, AI processing, and support. Those services may have their own terms and policies.

10. Intellectual property

CounterHype, including its name, design, software, training logic, text, branding, and content, is owned by CounterHype or its licensors. You may use the app for your personal use, but you may not copy, resell, or create competing services from it without permission.

11. Service changes and beta features

CounterHype may change, pause, remove, or add features over time. Beta, preview, or early-access features may change more often and may not work perfectly.

12. Termination

You may stop using CounterHype at any time. CounterHype may suspend or terminate access if you violate these Terms, create risk, fail to pay for paid access, or misuse the service.

13. Disclaimers and limits of liability

CounterHype is provided on an "as is" and "as available" basis. To the fullest extent allowed by law, CounterHype disclaims warranties and is not liable for indirect, incidental, special, consequential, or punitive damages, or for injuries, losses, or decisions resulting from your use of fitness, nutrition, AI, or health-related information in the service.

14. Consumer rights

Some laws give consumers rights that cannot be waived. Nothing in these Terms limits rights you may have under those laws.

15. Changes

We may update these Terms as the product changes or legal requirements evolve. The updated date at the top shows when the Terms last changed. Continued use after changes means you accept the updated Terms.
